Where is the correct location to draw people's attention to a deal where you don't receive a part and are lied to by the vendor?

Re: ripped off

Just post it here. There is no "correct" way as it varies with every vendor and who the particular mod is that is signed on at that time whether the thread stays or goes.

Certain vendors get their feedback topics locked in 30 seconds while others are allowed to go 10 pages.

So in reality, there is no proper way to do something that should never happen in the first place

Re: ripped off

1 October - I pay B&M $320 for a lower as he says it is in stock

2 October - no contact as inbox full - e-mail sent to B&M Industries:

Quote:
Mate,

I have heard nothing despite sending you $320.

Please can you contact me to put me at ease. Your PM inbox is full.

Thanks,

Mark

Subject: RE: intake

Yes sir. Your intake is in route. I shipped it SUPS to Race Proven. Should be there in a few days. Sorry for the delay. Had friends father die at the age of 48. That sucks. Way too young. Anyway sorry again.

Dameon

My response:

Quote:
Dameon,

my condolences - hope you are ok.

Which address did you send the intake to please? 9775 Variel for RPM?

Also, did you mean USPS? - what is SUPS?

Thanks,

Mark

Still having not heard that RPM had the intake by this Monday, I asked B&M Industries the following in a PM on this site:

Quote:
I am getting nervous about the lower. Still no sign of it. Which day did you ship it?

to which the response was:
Quote:
Mark, don't panic. I shipped it Friday last week. It should be there by today or tomorrow

This message was sent on 16 Oct 07, meaning friday last week was the 12th Oct, not the 9th Oct as previously stated.

I replied with
Quote:
You shipped it on Friday?

Mate - I paid for it on 1 Oct and you said it was in stock. I am pretty annoyed as you told me you shipped it last Monday. I was pestering Mike at RPM every day as this is delaying my project considerably.

I realise that you had some family issues but I don't appreciate being misled. There are other people that are waiting on this stuff, not just me.

What am I supposed to make of this? I am now reluctant to make any further arrangements until the lower turns up.

I then filed a complaint with paypal and sent the following e-mail:

Quote:
Dameon,

I have filed a paypal dispute for the lower intake. I will close it if the intake appears but as it stands I am preparing to submit negative feedback on syty.net for the following reasons:

Late shipping - you said the lower was in stock yet even though I paid on the 1st October, you said it was not shipped until the 9th

Poor communication - you attributed this to a funeral.

Misleading shipping dates - you said that the item shipped on the 9th October then today you said that it shipped on 12 October. I have no idea what to believe now. I am now skeptical as to whether there was a funeral or not.

If I receive the item at RPM by Friday then I will close the paypal dispute but given the three issues above I cannot give you anything other than negative feedback.

I hope the lower appears soon but can only advise that if you deal with someone after taking their money then you should treat them with a little more respect.

i.e. prompt shipping / give facts only - not contradictory shipping dates and above all stay in contact.

Regards,

Mark Edwards

This was the response:

Quote:
Mark, the Intake was indeed shipped Oct 12th. It was shipped it 2 day Priority mail through USPS. I was not the person who shipped the intake. My partner for the parts business that we have on the side is the one who shipped it. Yes my father friend did indeed die. We both have full time jobs and only do this on the side. We ship out 10-20 parts each week. I am sorry I didn't get your intake out in a timely manor. I am not trying to stiff you on a intake. It will be there today or tomorrow. I did have the intake in stock. I don't think the lower intake is the only thing holding up you build at RPM. Anyway The intake is on it's way.

Sorry again,
Dameon

I then received notification IN A PUBLIC THREADSee above post)

it will be there today or tomorrow. Sorry for the delay.

Those of you interested still will find that the USPS number above does not correspond with any known shipment.

I spoke with Mike at RPM this evening to work outr alternatives and was told that this guy Dameon had called to ask where it was having shipped it on the 15th - not he told me the 9th and the 12th previously.

As of 2240Z:

Then item shipped on the 9th, 12th and 15th October - 3 separate dates now
I am down $320
I have no intake
The USPS number does not correspond to anything.

I hope this saves someone getting messed around like I have been.

BEWARE B&M Industries

I still need an intake

I will wait until Friday before escalating the PayPal case against B&M for a refund.

Regards,

Mark

Before you flame someone, have you tried to resolve the problem with the Vendor?

The vedors forum. We as the staff here don't like to deal with it. These are personal issues, that need to be resolved by the two of you. The vendors have their own forums, and will handle it.

If your vendor doesn't have a forum, then post it in the lounge.

Re: ripped off

Syclone#1992 - he does not have a forum hence the lounge.

4C FED - Every time I have a contact with him he gives me a new shipping date. Once is forgiveable, the second time was offensive, but to have 3 separate dates as the official dates is unacceptable.

That and the fake USPS number means I feel aggrieved and people should know.

I don't trust a word until I get an intake or my money back.

Sorry if this is not the right way but I am furious.

Don't wait too long for your PayPal dispute - I think they have a 30-day limit for refunds.

Re: ripped off

Mark, I was not trying to rip you off. Like most of the vendors on this board, I have a full time job, and only sell parts on here to help out the community, which I have been a part of since the original email message board days before syty.net was conceived. Most of the Administrators know me and know the type of person I am. I assure you that a friends father did die and the lower intake did ship. The part was shipped from NY and is going to RPM in Cali. I personally called Mike Lee today and asked him if he received the intake. He was out running errands and said he would check when he got back.

I don't know what else you would like from me. I am sorry for the inconvenience.

Sorry again,

Re: ripped off

USPS tacking is crap. I wouldn't get too pissy that you can't look up a usps # on their website. It won't work until after the delivery is made usually.

Re: ripped off

X3.... in fact, I don't know where the - came from in your USPS# but if you leave the - out and run the tracking on the USPS site you will get:

"Label/Receipt Number: 3510 2805 6400 96

Delivery status information is not available for your item via this web site."

Which means it has not been signed for as of yet. Mark I know you are pissed and to a point, rightly so with regards to the delay, different dates etc. but I have done business with Tom and Dameon more than a few times and there parts are TOP QUAILITY EVER TIME. I had a little delay once before also but since when is anything with these trucks on schedule (not that is a valid reason for delay's)? I bet you $50 bucks that the intake arrives in the next couple of days.

Only other thing I can think of is that even though Tom and Dameon do have "real jobs" and do this as a sideline, they should let folks know that shipping dates can be a little "loose" at times up front. Like I said, the parts quality is GREAT even though responses can sometimes be a little slow and neither Tom or Dameon have every had a bad deal that I know of. If the box has been lost or delayed by USPS that is beyond their control and even the post office will tell you (UPS &FED X as well) that a lost claim can't be filed for 30 days and that is Federal Interstate Commerce Law.

Tom & Dameon will stand behind the sale for sure  ! Just give them a few more days.. and I hope this doesn't stop you from future business with them cause they have some real real clean primo parts that you may need in the future :2cents:

I have been waiting 218 days for $215. Maybe I would have had my stuff here already if I took an early approach. Thanks HotRodV6.

Re: ripped off

I understand what people are saying about the USPS, and I appreciate that some of the vendors on here do this as a spare time/hobby venture.

Let's just ignore the USPS thing for now.

My main gripe is that I have been given 3 different dates for when the item was shipped.

I cannot be any more clear than that - 3 separate dates.

Not when it WOULD ship, but that it HAD shipped.

I can deal with delays if forewarned, but to be planning on an item that hasn't even left yet, how can you work like that?

As far as being in this part time - if you take someone's money the buyer deserves some respect. I have a job as well. Better communication from the outset, pre warning of any delays or problems and reliability.

In this case I have had nothing but promises so far which have all failed to materialse.

Like I said in the e-mail - no intake by Friday, I escalate with paypal.

Re: ripped off

I am telling Mark, it did ship, and will be there. Tom did ship it on the 15th of Oct. I am truly sorry for the delay. I did learn a couple of good lessons with this transaction. One of your email, you said that "If I receive the item at RPM by Friday then I will close the paypal dispute but given the three issues above I cannot give you anything other than negative feedback." It is not friday yet. You already left neg feedback.

Just like others have stated USPS sucks for tracking orders. We have done tons of business with people on here, they know we infact deliver what we say will be delivered. I do agree with you that I should have shipped it out sooner. Sorry again for that.

I don't really know what else to say to you to ease your mind.

Later,

Re: ripped off

Did Mike ever look for the part? It could be sitting there, no fault to anyone. Hopefully our friend in the UK gets this taken care of. Its frustrating enough to try and fix a Sy or Ty here in the States, I can only imagine how retarded it must be to do it from over yonder.
