pulled over twice within 150 yards of one another by two different police departments

heavy breather

FBI enforcer
Had to go pick up my daughters car tonight...about 45 minutes ago, and let my future son-in-law drive the Ty back. We pulled out onto the main rd, he was following, and next thing I see is blue lights...he gets stopped. 3cruisers, and a drug dog search later.....they say "what we pulled you over for was the license plate light is not working....you better get that taken care of." So I wait in the dark till they let him go, and as he pulls in behind me another cop pulls him over with the same license plate speach.....no tickets from either stop. But the second cop really like the GOT BALLS? on the back window. I know it was because we were out at 2 am, but he is convinced the truck is bad luck.
The best part was thta I was driving a car with headlights black outs so dark you could tell the lights were on and they didn't even bat an eye at me.

Son in law says screw that effn truck, " I think I'll stick to mustangs."

Tell Dave it isn't the truck but the buy driving it. They can spot mustang owners in a heart beat and realize something is wrong.

I was hoping to be his future son-in-law but his daughter found someone else.

There was probably a truck matching that same description wanted in relation to a robbery or some other crime. Unfortunately, your son in law was in the wrong place at the wrong time

That's the first sign that he's not worthy of your daughter, you better push a wedge between the two :rotf:

The 4th ammendment to the Constitution, also known as The Bill of Rights.

'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized

Cops have no right to search unless they have probable cause.Driving without a license plate light doesn't give them them right to search your car.

So if you have nothing illegal in your home, you are ok with them randomly walking in your front door and tossing the place, right?

Re: pulled over twice within 150 yards of one another by two different police departments

I have a funny story about this.

Someone I know got in an accident, hit his head on rear view mirror. As he was sitting in ambulance awaiting to go to hospital (cut requires several stitches) he asked the cop to get his back pack from the car.

Well the cop did, but took it upon himself to look in the bag where he found a scale and money. So directly after hospital visit they arrest him for possesion with intend to sell. (no drugs found).

Fast forward to court date.

Judge "Officer, the first thing your job is to stay out of peoples private lives, you had no business to look into the bag case dismissed!"

I think the returned scale and money also.

Of course after the cops were pissed and had this person on there "hit" list. Yes they have them. Anytime he got pulled over he was subject to extra attention.

But we do forget cops are not god, we do have rights and rarely use them when faced by an cop.

Thanks for the refresher, I'm very familiar with the 4th.

I think you missed my point. What I meant was if you don't have anything to hide and a police officer asked to search, whats the big deal?

Oh yeah, in NY state a police officer can search the area that you can reach from your seat without probable cause for officer safety. :fuzz:

No, I caught your point entirely. My point was simple - Unless the officer can cite a specific REASON for desiring to search my vehicle, and back up said reason with hard supporting evidence known as probable cause, he can kindly stay the F out of my belongings. :)

The big deal is in the fact that just because he is a police officer, that does not give him the special right to do as he pleases. He is required to follows the very laws he is sworn to uphold, and one of them is my right to privacy against unlawful search and seizure. Now, if he walks up and I have contraband in plain sight, or my car reeks of marijuana, then he has every right to search. However, if he decides to search just to search, which is what we are discussing, he doesn't get to do that.

I think we all need to read this again. I missed this the first time also. No Probable cause needed in NY because you have no reasonable expectation to privacy outside your car, which is where the drug dog will start, walking around the outside of your car. If he gets a hit, you'll be on the roadside while a officer gets a search warrant for your car.

Once a drug dog triggers, that is considered probable cause, and no warrant is required at that point. However, if a dog triggers, and nothing is found, the citizen has recourse in the form of a lawsuit against the police department for invasion of privacy. Few have ever attempted this, however.

This may well be the difference. I agree that I do not know enough about NY laws to really comment. I just know the 4th really really well ;)
